Tax claim facts for individuals who live outside of the UK, and have income from a UK source
If you are not a resident in the United Kingdom, you can apply to receive full or partial tax relief on UK income. You may also be able to claim tax back that you have already paid on your UK income.

Non Residence Status
You will generally be classed as not resident in the UK if you have lived, or plan to live, outside of the UK for at least 3 years, or you have lived and worked full time outside of the UK throughout the last complete tax year, or you have accompanied your spouse or civil partner, who lived and worked full time outside of the UK throughout the last complete tax year.
To be classed as non resident for UK tax purposes your visits to the UK, for example holidays or business trips, must be less than 183 days in each tax year, and average less than 91 days per tax year over 4 consecutive years.
Double Taxation Agreement
Governments of many countries enter into Double Taxation Agreements which are designed to ensure the same income or gains are not taxed in more than one country, or where applicable tax is charged at a reduced rate.
If you are a resident of a country with which the UK has a Double Taxation Agreement, you may be able to claim full or partial relief from UK tax on certain types of income from UK sources.
UK Income
The types of UK income that tax relief can be claimed on include dividends, interest on savings, rental income, pensions, annuities, trusts and employment in the UK. To be eligible these incomes must have been received from a UK source.
UK Non Resident Tax Relief
You will need to get a certificate from the tax authority in the country you are living stating that you are resident there for tax purposes for the full period of the claim.
Each case will be individually reviewed by HMRC as every claim for UK non resident tax relief will be different.
Self Assessment
A Self Assessment Tax Return will need to be completed for each relevant tax year, unless otherwise stated in writing by HMRC.
Due to HMRC rulings and legislation Tax rebate claims for UK Non Residents are particularly complex. A person’s eligibility for a UK Tax Rebate is particular to them and will need to be determined by an examination of their personal circumstances.
