Tax claim facts for landlords of UK property who live outside of the UK

If you are not a resident in the United Kingdom and you own rental property in the UK, you can apply to receive rental income without deduction of UK tax. You may also be able to claim repayment for some, or all, of the tax you have already paid.

UK Non Resident Landlord Scheme

If you left the United Kingdom 6 months or more ago you will generally be classed as a Non Resident for the purposes of HMRC’s Non Resident Landlord Scheme and can apply to receive any rental income from your property without UK tax deducted.

To apply you must complete either an NRL1, NRL2 or NRL3 form.

Letting Agents

Unless you have completed either a NRL1, NRL2 or NRL3 form letting agents have to deduct tax from the rental income of a UK Non resident Landlord, and pay this to HMRC on their behalf.

As an overseas landlord you should receive a Certificate of Tax Liability each year from your letting agent, to confirm that tax has been deducted from you rental income.

Property Expenses

When calculating the amount of tax you have to pay on your rental income, there are some allowable expenses which can be deducted, for example mortgage interest and property repairs. This will reduce the amount of tax you are entitled to pay.

Rental Income and Tax

If you meet the above criteria and are accepted for the scheme, any future income from your UK property will be received with no tax taken off, up to the value of your annual allowance (view the current UK income tax rates).

You can also claim tax back on rent already paid, resulting in a Non Resident Landlord tax rebate.

Self Assessment

A Self Assessment Tax Return (Link) will need to be completed for each relevant tax year, unless otherwise stated in writing by HMRC.

Other Income

Other UK income, for example investment or bank interest, will have to be taken into consideration when making a claim for tax back as a UK Non Resident Landlord.

Due to HMRC rulings and legislation Tax rebate claims for UK Non Residents are particularly complex. A person's none resident status is particular to them and will need to be determined by an examination of their personal circumstances.
